The Cost of Livin’

Here’s some not so good bankruptcy news for you. The price to file is going up. As of the First of June, it will now cost you $335.00 to file for chapter 7 bankruptcy. The cost to file for chapter 13 is going up to $310.00.

In the grand scheme of things, this is not an earth-shattering increase in price. But if you are strapped for cash enough to contemplate filing for bankruptcy, then every penny counts. So should you hurry up and file to beat the deadline?

Haste Makes Waste

Filing for bankruptcy is a precise business. One simple, small mistake can magnify after filing into a tragic loss of property or cash. The consequences you could face by filing too quickly are far greater than the small amount of money you would save by filing before June.

Don’t Rush the Expert

Even if you want to risk the consequences of a rushed bankruptcy to save some money, your attorney may not want to, or may not be able to. A competent bankruptcy attorney will never file a case unless he or she feels it has been thoroughly prepared for filing. Would you rather have your case filed quickly, or filed correctly?

In addition, your attorney has to prioritize which cases to file when. There is only so much time and resources that can be devoted to your attorney’s entire caseload. For example, a client with an ongoing wage garnishment may need to file right away to prevent the loss of more income. His case will likely get pushed in front of yours in order to file it expediently.

The Conclusion

It should be obvious by now that bankruptcy should not be rushed into unless absolutely necessary. There are few circumstances that call for a bankruptcy to be filed right away, and it’s difficult to argue that saving around 25 dollars is such a circumstance. You are probably pinching every penny before your case is filed, but your bankruptcy filing fee is one place in your budget you might just have to pencil in a few dollars more.
